    I. Legislation

    (a) General

    A claimant or a claimant's employer may appeal a decision of the Commission to a Board of Referees within thirty (30) days of communication of that decision to the party who is appealing. The Commission may extend the thirty (30) day time limit where it is satisfied that "special reasons" exist.

    Subsection 114(1) Employment Insurance Act

    Where an appeal involves the issue of "sexual or other harassment" as just cause for voluntarily leaving employment, the Chairperson of the Board of Referees has the discretion, on application by the claimant, to hold the hearing in private or to prohibit the details of the case from becoming public.

    Subsection 114(2) Employment Insurance Act

    A decision of the Board of Referees must be in writing and must contain a statement of the findings of the Board on questions of fact material to the decision.
