    (b) Appeal Procedure

    An appeal to the Board of Referees must be in writing and must contain a statement of the grounds of appeal. The appeal is to be filed at the office of the Commission from which the claimant or the employer received notification of the Commission's decision.

    Section 79 Employment Insurance Regulations

    Where a claimant files an appeal to the Board, the employer may also apply for a hearing within seven (7) days after receiving notice of the appeal. In the same manner, where an employer files an appeal, a claimant may also apply for a hearing before the Board within seven (7) days after receiving the notice of appeal. These applications for a hearing must be made in writing and filed at the office of the Commission where the appeal has been filed.

    Section 80 Employment Insurance Regulations

    Subsection 80(3) of the Employment Insurance Regulations is a new provision which allows an interested party other than the claimant or the employer, to apply for a hearing before the Board of Referees. The application must be in writing and filed at the office of the Commission where the appeal has been filed.

    The Chairperson of the Board may, at any time, direct that there shall be a hearing, and where an application for a hearing has been made by a claimant, employer or other interested party, the Chairperson must grant a hearing.

    Subsection 80(5) Employment Insurance Regulations

    A person who is required to attend a hearing before the Board of Referees must be notified in writing by the Chairperson or by an officer of the Commission.

    Subsection 80(6) Employment Insurance Regulations

    The Commission may make regulations with respect to the practice and procedure of hearings before the Board of Referees. The procedure at a hearing shall be determined by the Chairperson.

    The Chairperson of a Board of Referees may, at any time prior to the decision of the Board, refer any question arising in relation to a claim for benefit to the Commission for investigation and report.
